That menu thing looks like a singleplayer anomaly, and I would put it there. And a judgement call is required on your part before the game can be properly graded; how big an impact does this anomaly have on the game? Consider how often it comes up, and how much of a gameplay disadvantage it is.

Here are some examples of evaluations of miscellaneous flaws I've decided in the past.

Minor:
Transaction screens stretching in Age of Wonders 2
Tarot card screens stretching in Painkiller
Journal pages stretching in Psychonauts
Whited out loading screen in Jedi Knight II
Stretched inventory screens in Jedi Academy
Atlantis levels being Vert- in Unreal 2

Major:
Tactical view becoming Vert- in Brothers in Arms
Map stretching in Doom II
Map stretching in Giants: Citizen Kabuto
HUD elements being cut off in Soldier of Fortune 2

Moved the menu piece. I called it minor. You can still reach every menu option, and you don't have to look at the menus that often. The only thing cut off is a description box.
